Lasting Power of Attorney
A Lasting Power of Attorney is a vital document for every adult, to enable the appointment of a person to manage your affairs should you become unable to manage them yourself due to a loss of ‘Mental Capacity’. It is ‘completed’ whilst capacity is still intact and ‘kept’ until needed. The person continues to make decisions themselves until capacity is lost. There are two types of Lasting Power of Attorney: 1. Property and financial affairs (Allowing an attorney to make decisions about paying bills, dealing with the bank, collecting benefits, selling your house, etc.) 2. Health and welfare (Allowing decisions on treatment, care, medication, where you live, etc.) Enduring Powers of Attorney are the earlier version of the Lasting Power of Attorney Property and Financial Affairs. No new Enduring Powers of Attorney can be created. Any EPA signed from 1st October 2007 onwards is not legal. Existing EPAs dated before that are potentially still valid. But they cannot be changed in any way. Around 60% of us will lose the ability to make decisions at some stage in our lives:
- Emergency decisions during an operation
- Alzheimer’s and dementia is becoming more common
- Car accident or a fall can happen to anyone, anytime
- Mental health issues
- Loss of faculties with age
- If you don’t have a Lasting Power of Attorney then it is up to the Court of Protection to make those decisions for you until such time as it appoints a “Deputy” to manage money and welfare matters for you. As you can imagine, that is a slow and expensive process and the Court of Protection may not appoint the person you would have chosen to look after your interests
- A Lasting Power of Attorney is crucial for everyone over 18
